6. Liability
The provider is liable without limitation for intent and gross negligence, for damage arising from injury to life, body, or health, for fraudulently concealed defects, under an expressly assumed guarantee, under the German Product Liability Act, and in all other cases in which liability cannot legally be excluded or limited.
In cases of slight negligence, the provider is liable only for breach of a material contractual obligation whose fulfilment is essential for the proper performance of the respective contract and on whose fulfilment the other party may normally rely.
